TEXAS OPEN RECORDS ACT
WHEREAS, The Texas Open Records Act governs the ownership of and access to public records; and
WHEREAS, Records produced in the conduct of public business are public records which should be alienated from state custody only through due process of law and records produced in the offices of the departments of state government are not and should not become the private property of office holders upon the expiration of their terms; and
WHEREAS, Attorney General's Opinion JM 1013 states that current law on these issues is clear and satisfactory; now, therefore, be it
RESOLVED, That the Texas Library Association opposes the effort to alter existing statutes as embodied in HB 2758.
